The purpose of this document is to define the terms and conditions under which, on the one hand, Bellisoft, hereinafter referred to as the EDITOR, makes available to its users, hereinafter referred to as the USERS, the site www.bellisoft.com, hereinafter referred to as the WEBSITE, and the services available on the WEBSITE and, on the other hand, the manner in which the USER accesses the WEBSITE and uses its services.

Any connection to the site is subject to compliance with these conditions.

For the USER, simple access to the SITE implies acceptance of all the conditions described below.

I. Legal notice

The edition of the SITE is ensured by the association law 1901 Bellisoft, whose head office is located at 48 avenue du Chateau, 91760 Itteville.

The purpose of the Bellisoft association is to develop, promote and foster cultural and social activities in the fields of history and games of strategy. It seeks, among other things, to promote

• the creation, innovation and practice of games in the above-mentioned fields
• the relationship between historians, history lovers, players and game creators ;
• the research and publishing of data related to military strategy and history.

The director of the publication of the SITE is Mr Tristan Pannérec.

The host of the SITE is O2switch SARL with a capital of 100000€ whose registered office is located in Clermont-Ferrand (France).

II. Intellectual property

Unless otherwise stated, the general structure of the SITE, as well as the source codes, texts, graphics, images, sounds and videos making it up, are the property of Mr Tristan Pannérec. Any representation and/or reproduction and/or partial or total exploitation of the contents and services offered by the SITE, by any process whatsoever, without the prior written authorization of the EDITOR or the author is strictly prohibited and may constitute an infringement within the meaning of articles L 335-2 and following of the Intellectual Property Code.

III. Hypertext links

The SITE may contain hypertext links to other sites on the Internet. Links to these other resources take you off the SITE.

It is possible to create a link towards the page of presentation of this site without express authorization of the EDITOR. No prior authorization or request for information may be required by the publisher with respect to a site that wishes to establish a link to the publisher's site. However, this site should be displayed in a new browser window. However, the EDITOR reserves the right to request the removal of a link that it deems not to be in conformity with the purpose of the SITE.

IV. Publisher's responsibility

The information and/or documents available on this site may be modified at any time and may have been updated. In particular, they may have been updated between the time they were downloaded and the time the USER becomes aware of them.

The use of the services available on this site is entirely and solely the responsibility of the USER, who assumes all the consequences that may result, without the EDITOR being sought as such, and without recourse against the latter.

In no event shall THE EDITOR be liable for any damages whatsoever resulting from the interpretation or use of the information and services available on the SITE.

V. SITE access

The USER not registered on the SITE does not have access to services reserved for registered persons. To access it, he must create an account by providing an identifier, a valid email address and a password.

The registered USER is identified by his username and password. It is the USER's responsibility not to disclose these elements and to ensure that his password remains secret. The EDITOR cannot be held responsible for the use of an account by a third party USER.

The USER who is not a member of the Bellisoft association does not have access to the SITE services reserved for members. To access it, he must join the association and pay a membership fee.

The USER acknowledges accepting the use of session cookies to facilitate navigation on the SITE.

The EDITOR shall endeavour to allow access to the site 24 hours a day, 7 days a week, except in the event of force majeure or an event beyond the EDITOR's control, and subject to any breakdowns and maintenance interventions necessary for the proper operation of the site and services.

Consequently, the EDITOR cannot guarantee the site and/or services availability, transmission reliability or performance in terms of response time or quality. No technical assistance is provided to the USER either by electronic or telephone means.

The EDITOR cannot guarantee the compatibility of the SITE and the services provided with all existing hardware and applications, nor the absence of anomalies or bugs.

The EDITOR may not be held liable in the event of impossibility of access to this site and/or use of the services, nor in the event of force majeure or events beyond its control.

In addition, the EDITOR may interrupt the site or part of the services at any time without notice, all without right to compensation. The USER acknowledges and accepts that the EDITOR is not responsible for interruptions and consequences that may result for the USER or any third party.

VI. Using the SITE

The USER undertakes to use the contents of the site in a strictly private context. The use of the contents for commercial purposes is strictly prohibited.

The USER undertakes not to use the SITE and its services in such a way as to manifestly harm the EDITOR and its partners. In case of obvious damage, the USER shall be financially liable for the damage caused.

Any content put online by the USER is his sole responsibility. The USER undertakes not to put online any content that may harm the interests of third parties. Any legal action brought by an injured third party against the site shall be borne by the USER.

The USER undertakes, under all circumstances, to remain courteous and polite towards other users of the site and to exercise restraint in such communications.

The content put online by the USER may at any time and for any reason be deleted or modified by the EDITOR. The USER receives no justification and notification prior to the deletion or modification of the USER's content.

VII. Modification of the conditions of use

The EDITOR reserves the right to modify, at any time and without notice, these terms of use in order to adapt them to changes in the SITE and/or its operation.

VIII. Internet usage rules

The USER declares that he accepts the characteristics and limits of the Internet, and in particular acknowledges that:

The EDITOR assumes no responsibility for the services accessible via the Internet and has no control whatsoever over the nature and characteristics of the data that may be transmitted via its server centre.

The USER acknowledges that data circulating on the Internet is not protected against possible misappropriation. The communication of any information deemed by the USER of a sensitive or confidential nature is at the USER's own risk.

The USER acknowledges that data circulating on the Internet may be regulated in terms of use or protected by property rights.

The USER is solely responsible for the use of the data he consults, queries and transfers on the Internet.

The USER acknowledges that the EDITOR has no control over the content of the services accessible on the Internet.

IX. Personal data, confidentiality

The EDITOR does not collect through the SITE any personal information and no personal information outside a contact email address. The EDITOR undertakes never to disclose this address to anyone without the USER's consent.

X. Applicable law

Both this site and the terms and conditions of its use are governed by French law, regardless of the place of use. In case of possible dispute, and after the failure of any attempt to seek an amicable solution, the French courts will have sole jurisdiction to hear this dispute.
